Terms of Use
1. Terms and Conditions
In order to use the blog services provided by FC2, Inc. (FC2 blog, we, us, or our) you (user, members, or your) must first agree with our Terms and Conditions Policies. This agreement sets out legally binding terms for your membership, and may be modified from time to time without prior notices.
2. Eligibility
By using FC2 services, you will abide by the Terms and Conditions set forth from this company. Agree to the following:
- Represent and warrant that all your information that you (“user or visitor”) have given to us is true and accurate, and you will maintain accuracy of such information.
- You are age 13 or older. (If we have any reason to believe you are under 13 years of age, are under 18 and claim to be 18 or older, or are older than 18 and represent yourself as under 18, your profile and membership may be terminated without warning.)
- Do not violate any applicable laws or regulations.
- Be fully responsible for your account, and for any actions taking place in you account.
3. User Conduct
- The following are examples of the kinds of content that is illegal or prohibited to post on or through FC2 Services. FC2, Inc. reserves the right to investigate and take appropriate legal action against anyone who violates the FC2 Terms and Conditions. It is in FC2’s sole discretion including, but not limited to terminate offending and inappropriate content. We will also terminate violators who post offensive and inappropriate content when using our services.
- You may not post, transmit, or share images that you did not create or did not have permission to post. Again, FC2 Reserves the right to delete or remove any contents without the users notice.
- You may not post, transmit, or share images that are not related to FC2 blog.
- You may not violate the privacy rights, publicity rights, copyrights, trademark rights, contract rights, or any other rights of any person or company.
- You may not constitute or promote any illegal or unauthorized copy of another person’s copyrighted work, such as providing links to pirated computer programs, also providing information to evade manufacturer installed copy protect devices. It is also illegal to provide information or links to pirated music files.
- You may not suggest, promote or instigate any criminal activity or enterprise in providing instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone else’s privacy, providing or making computer viruses.
- You may not harass or advocate harassment to other individuals or groups.
- You shall not interfere with or disrupt the service or servers, or the networks connected to our service. Please follow requirement procedures, policies, and regulations of networks connected to the service.
- You must be truthful about your identity and not impersonate any person or entity, including, but not limited to, an FC2 official, forum leader, guide or host. Do not falsely state or otherwise misrepresent your affiliation with a person or entity.
- You may not intentionally or unintentionally violate any applicable Local, State, National or International Law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission. Any rules of any National or other securities exchange, including, but without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law.
- You may not harm or disrupt another user's computer or would allow others to illegally access software or bypass security on web sites or servers, including but not limited to spamming.
- You may not provide material that exploits people under the age of 18 in a sexual or violent manner, or solicit personal information from anyone under 18 and display pornographic or sexually explicit material in any shape, way, or form.
- You may not solicit passwords or personal identification information of any kind for commercial or unlawful purposes from other users; and engage in commercial activities and/or commercial sales without our prior written consent, including, but without limitation to: contests, sweepstakes, barters, advertisement, and pyramid schemes.
- You may not transfer this Agreement to third-party beneficiaries.
- You may not threaten, stalk, defame, defraud, degrade, victimize, or intimidate an individual or group of individuals for any reason; including on the basis of age, gender, disability, ethnicity, sexual orientation, race, or religion; or to incite or encourage any one else to do so. We strictly prohibit discrimination.
- You may not promote or encourage any behavior would be against the law.
- We have the right to consider any behavior as inappropriate.
- We reserve the right, at its sole discretion, to pre-screen, refuse, or remove any content that is in conflict with the rules stated above.
4. User Responsibilities
As an FC2 user you will uphold the following code of conduct, and are liable for all of your activities and posted content.
- Be respectful to other FC2 users. Follow simple rules and guidelines.
- If a user acquires any sort of damage from a suspended or terminated account, FC2 will not be responsible for any of the damages. The user must bear all responsibilities and debts.
- FC2 users will take full responsibility for any claims, protests, complaints, and other legal cases etc. filed against them.
- You should promptly inform us when you change your personal information.
- FC2, Inc. will communicate with users through e-mail or the FC2 user’s websites. You will be responsible to check on these messages and alerts on your own.
5. Disclaimer
- FC2 is not responsible for any damages or loss of information that may happen during your use of our services.
- You are solely responsible for your interactions with other FC2 users.
- FC2 reserves the right to do server-based operations at any time without prior notice of suspension or termination of our service.
- FC2 has no obligation to store user information. We are not responsible for any damages acquired during your use of FC2 services.
6. Disputes
Agreements will be governed by, and interpreted in accordance with, the laws of the State of California. The user and FC2, Inc. agree to submit to the exclusive jurisdiction of the courts in the State of California to resolve any feuds coming out of the agreement or FC2 services.
7. Confidentiality
- FC2 will not share any user e-mail addresses or passwords to third parties.
- FC2 may access user information when it is specifically requested by the user or when maintenance operations are being performed.
- FC2 has strict policies in keeping user information confidential. However, we may access user information for the following reasons:
- When the user specifically requests for it, and only with the user’s consent.
- Based on legal provisions.
- Based on the request from judicial or other legal procedures.

8. Suspension/Termination
- FC2 reserves the right to delete user accounts at any time and without prior notice, when the following situations arise:
- When a user uses false information when applying for FC2 Services.
- If we find a user has violated any part of article 3. User Conduct.
- If we feel, or have any reason to believe that a user does not fit the requirements to be a FC2 user.
- The user will not be bound by our agreement after the user cancels or is deleted from our services.
- If a user acquires any sort of damage from a suspended or terminated account, FC2 will not be responsible for any of the damages. The user must bear all responsibilities and debts. This is also stated in article 4. User Responsibilities, section 2.
9. Change of Terms
FC2 reserves the right to amend or change the Terms of Service at any time without prior notice, and encourages you to periodically review these guidelines to ensure you are in compliance. November 4th, 2008.
